Asbestos in Rental Properties: Landlord Duties

Around 5,000 people die each year in the UK from asbestos exposure. If your rental was built before 2000, asbestos is probably in it. Here is what you must do.

# Asbestos in Rental Properties: Landlord Duties

Asbestos was widely used in UK construction until it was fully banned in 1999. Around half of the housing stock in England — particularly properties built 1930–1999 — contains some form of asbestos-containing material (ACM). For landlords, the risk is not the asbestos itself but disturbing it during repairs, refurbishment or tenant alterations.

For a single-family AST, the property is "domestic" and Regulation 4 does not apply directly inside the let unit. But:

  • Common parts of a block of flats ARE non-domestic.
  • HMOs ARE non-domestic.
  • The moment you commission any work, the contractor is in a workplace.
  • Tenant safety duties under the Health and Safety at Work Act apply.

In practice, every landlord should know where asbestos may be in their property.

Levels of asbestos

"Friable" means the material crumbles and releases fibres. Damaged, sanded, drilled or weathered ACMs are friable. Intact, sealed Artex is not.

When you must survey

  • Management survey required before any refurbishment in a HMO or flat communal area.
  • Refurbishment & Demolition (R&D) survey required before ANY work that disturbs the fabric — in any property, regardless of single-family or HMO.
  • Recommended before purchase of any pre-2000 property as part of the buyer survey.

Survey costs:

  • Management survey: £200–£400.
  • R&D survey: £400–£800.
  • Sample analysis: £50 per sample at UKAS lab.

What to do if asbestos is present

The default is manage in place, not remove. Asbestos sealed inside paint, behind plasterboard, or encapsulated in vinyl tiles releases zero fibres if left alone. Removal creates risk.

Manage by:

  1. Recording the location in your property file.
  2. Briefing every contractor before they enter.
  3. Encapsulating with paint or sealant if surface damaged.
  4. Monitoring annually for damage.
  5. Telling tenants in writing not to drill, sand, scrape or pierce specific surfaces.

Remove only when:

  • The material is significantly damaged.
  • The refurbishment makes removal unavoidable.
  • The material is in a high-traffic area at risk of repeat damage.

Find licensed contractors via the HSE register. Costs:

  • AIB ceiling removal in a small room: £600–£1,200.
  • Pipe lagging strip and refit: £300–£600 per meter.
  • Full house Artex skim-over: £2,000–£4,000.
  • AIB or sprayed asbestos full removal: £5,000+.

Tenant alterations

The single biggest source of asbestos exposure in rentals is tenants DIYing — drilling for shelves, sanding ceilings, removing tiles. Mitigate by:

  • Including a clause in the tenancy agreement banning alterations without written consent.
  • Issuing an asbestos-aware tenant briefing at check-in if pre-2000.
  • Recording known ACM locations in the inventory and tenant pack.

Refurbishment between tenancies

Before any work:

  1. Commission R&D survey (legal requirement before disturbance).
  2. Give survey report to every contractor.
  3. Confirm contractor has asbestos awareness training (UKATA or IATP).
  4. Licensed contractor for any AIB, lagging, sprayed material.
  5. Keep waste consignment notes for 3 years minimum.

Penalties for non-compliance

  • HSE prosecution under Control of Asbestos Regulations: unlimited fines, up to 2 years imprisonment.
  • Civil claim by exposed worker or tenant: 6-year statute of limitations from awareness, no upper limit.
  • Refused insurance for any future asbestos claim if disturbance was negligent.

Frequently asked questions

Do I have to survey my rental for asbestos?+

Not for single-family lets unless you are about to refurbish. For HMOs and communal areas of flats, Regulation 4 of the Control of Asbestos Regulations 2012 requires a management survey.

How do I know if asbestos is present?+

Any property built before 2000 should be presumed to contain it until surveyed by a competent professional.

Is it safe to leave asbestos in place?+

Generally yes if undamaged and sealed. Disturbing it releases fibres, so management beats removal in most cases.

Can I remove asbestos myself?+

Cement-based external sheets can technically be removed by a competent person with PPE, double bagging and licensed waste disposal — but this is not recommended. AIB, lagging and sprayed material must be removed by an HSE-licensed contractor.

What is an R&D survey?+

A Refurbishment & Demolition asbestos survey. Required before any disturbance of the property fabric, regardless of property type.

How much does an asbestos survey cost?+

Who is responsible — landlord or tenant?+

The landlord — both for management and for any commissioned work. Tenants must be advised but cannot be held responsible for hidden ACMs.

What about Artex ceilings?+

Pre-2000 Artex typically contains chrysotile asbestos. Safe if undamaged. Skim-over by a competent plasterer with notification is the usual approach.

Does my insurance cover asbestos claims?+

Public liability covers accidental exposure if you took reasonable steps. Negligence (e.g. allowing builders to disturb known ACMs) usually voids cover.

What happens if a tenant drills into an asbestos wall?+

Stop work immediately. Damp the area, isolate the room, and call a licensed contractor. Notify the tenant in writing and consider environmental clean-up sampling.

Are there any properties exempt?+

Properties built after 2000 are exempt from the presumption. Always check construction date — extensions added later may also be asbestos-free.
