How to Handle a Tenant Claiming Universal Credit

Introduction
Around 1.6 million private rental households now claim Universal Credit. With the monthly-in-arrears payment model, arrears are routine — but UC also has a built-in route for direct payment to landlords where things go wrong. Here's how to use it.
How UC pays for housing
Universal Credit includes a housing element based on Local Housing Allowance for private tenants. It's paid as part of the single monthly UC payment, in arrears, on a fixed assessment-period date. The tenant must then pass it to you.
Apply for direct payment (APA)
Form UC47 — 'Request for Direct Rent Payments' — can be submitted by the landlord, tenant or third party where: arrears exceed two months of rent, the tenant has rent arrears equivalent to 8+ weeks, or the tenant is in one of the 'Tier 1' vulnerable categories (homelessness, addiction, mental health, learning difficulties, domestic abuse).
Tier 1 vs Tier 2 vulnerability
Tier 1 (DWP must consider APA): homelessness, addiction, severe debt, learning difficulties, mental ill health. Tier 2 (APA should be considered): refugees, ex-offenders, ex-armed forces, those struggling with monthly budgeting. Provide supporting evidence with the UC47.
How payment works once granted
Paid four-weekly in arrears, typically into the bank account you nominate. UC will write to you and the tenant confirming the arrangement. Arrears deductions of up to 20% of the standard allowance can be taken from the tenant's UC to clear backdated rent.
Reviews
APAs are reviewed periodically — usually every 6 months. The DWP can lift the arrangement if circumstances improve. If reviewed off, you can re-apply on the same grounds if arrears re-occur.
Communication with the tenant
Direct payment to you does not mean the DWP becomes your only contact. Keep the tenant fully informed of every rent statement, deduction and balance. UC tenants who feel cut off escalate disputes quickly.
Possession and UC
Standard Section 8 grounds (8, 10, 11) apply equally to UC claimants. Courts increasingly expect landlords to show they applied for direct payment before pursuing eviction on rent arrears grounds. UC47 evidence strengthens the case substantially.
