Asbestos kills around 5,000 people in the UK every year — more than road deaths. For landlords of pre-2000 properties, asbestos isn't a hypothetical risk; it's a daily compliance issue. Here's how to manage it lawfully and safely.
Where asbestos sits in homes
Pre-1980 (most common): pipe lagging, water tanks, AIB ceiling tiles, sprayed coatings. 1980–2000: cement roof tiles, soffits, downpipes, garage roofs, textured wall and ceiling coatings (Artex pre-1999), floor tiles, vinyl flooring backing, internal partition panels. UK ban on chrysotile asbestos took effect November 1999.
The 'duty to manage' — Regulation 4
Control of Asbestos Regulations 2012, Regulation 4. Applies to non-domestic premises and common parts of domestic buildings (HMO corridors, flat block stairwells, shared cellars). Duty: identify, record, assess and manage. Pure single-family rentals fall outside Reg 4 — but Section 11 LTA 1985 and HHSRS still apply.
Survey types
Management Survey (CAR-2012, formerly Type 2): identifies asbestos likely to be disturbed in normal use. Sampling and analysis. Typical cost £200–£400 for a 3-bed house. Refurbishment & Demolition Survey (formerly Type 3): fully intrusive — required before any major works. £400–£800.
Risk levels and management
Low risk (sealed, undamaged): leave in place, label, monitor, record. Medium risk (minor damage): encapsulate or repair. High risk (damaged, disturbed, friable): remove. Friable asbestos (insulation, sprayed coating, lagging) is licensed work only — HSE-licensed contractor mandatory.
Textured ceilings (Artex)
Pre-1999 Artex usually contains low-percentage chrysotile asbestos. Generally lower risk — sealed by paint and undisturbed. Sanding, scraping or drilling releases fibres. Best practice: cover with new plaster or plasterboard (safe overcladding) rather than removing. Removal by HSE-licensed contractor only.
Refurbishment trigger
Any planned works that may disturb asbestos require a Refurbishment & Demolition Survey first. Bathroom rip-outs, kitchen replacement, electrical rewiring, plumbing work, loft conversions. Contractors will rightly refuse to start without a clearance survey.
Disposal
Asbestos waste is hazardous and must go to a licensed disposal facility — typically a local authority transfer station with asbestos cell. Bagged double, sealed, labelled. Disposal cost £50–£200 per bag. Fly-tipping asbestos is criminal (unlimited fine, jail) and increasingly enforced via fly-tipping cameras.
Disclosure and liability
Disclose known asbestos to: tenants on tenancy start (good practice, not strict legal duty), contractors before they start work (legal duty under CDM Regulations 2015), buyers via TA6 (legal duty). Failure to disclose to a contractor who is then exposed risks corporate manslaughter and £100,000+ fines.
