Frequently asked questions
▸How long do I have to protect a deposit?
30 days from receipt.
▸What is 'prescribed information'?
A statutory document explaining where the deposit is held and how disputes are resolved. It must be served to the tenant within 30 days.
▸Penalty for late protection?
Court can order 1× to 3× the deposit back to the tenant — plus you lose the right to serve Section 21 (becoming moot under the RRA but still relevant historically).
▸Which schemes are approved?
Deposit Protection Service (DPS), MyDeposits, and Tenancy Deposit Scheme (TDS).
▸Insured vs custodial?
Custodial = scheme holds the cash. Insured = you hold it, pay a small fee to insure. Choose insured if you want cashflow flexibility.
▸Do I re-protect on renewal?
Yes — confirm protection is still active and re-issue prescribed information.
▸What about holding deposits?
Capped at one week's rent under the Tenant Fees Act. Different rules apply.
▸If the deposit was paid by a third party?
Still must be protected. The prescribed information lists the payer too.
▸What happens at the end of tenancy?
Agree deductions, raise a dispute through the scheme if no agreement, or release the deposit.
▸Can I keep all the deposit?
Only with the tenant's agreement or via scheme adjudication. Unfair retention is a common claim.
